Please note that a year membership purchase requires a minimum of 12 months plus a pro-rated
month based on the activation date. A 4 month membership requires a minimum of 4 months,
plus a pro-rated month based on the activation date.

After your commitment is fulfilled, every term member will automatically continue
on a month-to-month basis at the then-current monthly dues rate unless this contract is
terminated. Monthly members will continue monthly until 30 days written notice is given.
IN ORDER TO TERMINATE THIS CONTRACT or membership, A MEMBER MUST COMPLY
WITH ARTICLE II SECTION 3,6 AND 8 of the membership agreement AS APPLICABLE, AND
MUST (1) GIVE THE STUDIO ONE FULL MONTH’S ADVANCE WRITTEN NOTICE,
AND (2) PAY ALL PAST DUE AMOUNTS OWED THE STUDIO

Disability or Death. If a member is permanently unable to use the facilities as provided herein due
to disability, or if said member dies, he/she and his/her estate shall be relieved from the obligation of
making payment for services other than those received prior to death or the onset of his/her disability. If he/she
has prepaid any sum for services, so much of such sum as is allocable to services he/she has not taken shall
be promptly refunded to him/her or his/her representative after receipt of written request. The
term “disability” means a condition with precludes the member from physically using the facilities now or
any time in the future and the condition is verified by a physicians sworn statement.

Voluntary Resignation. Members may resign from the studio after their term is complete.
Such voluntary resignation shall not be deemed effective until after the member has given the Studio thirty
(30) days advance written notice, after all required payments have been made by the member to the Studio.
After the Studio’s written acknowledgment of such voluntary resignation, the member shall not be subject
to any further dues or charges.

Change of Residence. If a member changes his/her principal residence to a location more than 20
miles from the Studio, such member shall be relieved from the obligation of making any further payments
of monthly dues other than for any month prior to the change of residence. In such event, if the member
has prepaid any monthly dues, the Studio shall deduct a pre-determined fee, not exceeding $100 or, if
more than ½ of the life of the contract has expired, a fee not to exceed $50 from the remaining amount, and
will calculate the refund based upon Vitality Fitness Inc.’s regular Monthly rates. Discounted rates for
having prepaid will not apply since the term was not completed. A membership refund based on a
change of residence must be proven to Vitality Fitness Inc.’s satisfaction before a refund or cancellation
is granted. We ask for two of the following documents as proof of residence change: Updated driver's license
with new address, rental/purchase agreement or utility bill with your name and new address.
